Our end-to-end legal services ensure a smooth, compliant, and timely process, often without the need for clients to physically travel to India.

What is a Succession Certificate?

A Succession Certificate is a legal document issued by a civil court under the Indian Succession Act, 1925, which authorizes the rightful heirs to collect debts and securities (movable assets) of a deceased person. It serves as proof of entitlement and enables banks, financial institutions, and companies to release funds or securities to the certified legal heirs.

When is a Succession Certificate Required?

This certificate is typically required when:

  • The deceased has not left behind a registered Will

  • Movable assets are held in their sole name

  • Legal heirs are seeking access to:

    • Bank accounts or fixed deposits

    • Shares, debentures, mutual funds

    • Insurance proceeds, provident fund

    • Post office savings or government bonds

Legal Heir Certificate vs. Succession Certificate

  • A Legal Heir Certificate is issued by local revenue authorities (Tehsildar or Municipal Office) to establish family relationships and is often needed for pension or employment-related benefits.

  • A Succession Certificate, however, is a judicial document issued by a district civil court, specifically for claiming movable assets, and carries more legal weight in financial and inheritance matters.

Our Legal Services Include:

  • Filing and pursuing petitions in the appropriate District Court having jurisdiction

  • Drafting affidavits, applications, and supporting documents

  • Identifying and including all Class I Legal Heirs as per personal law (Hindu, Muslim, Christian, etc.)

  • Coordinating with local courts and authorities for issuance and publication notices

  • Representing clients during hearings or objections

  • Ensuring court-compliant delivery of final Succession Certificate or Legal Heir Certificate

  • Assisting NRIs remotely without the need to travel to India

Documents Typically Required:

  • Death certificate of the deceased

  • Identity and address proofs of the applicant(s)

  • Details of the movable assets (bank accounts, investment statements, etc.)

  • Family tree / genealogy information

  • No objection certificates (if applicable) from other legal heirs
